LiveWest has submitted a ‘Pre Action Letter’ to the Government Legal Department, asking it to quash the Inspector’s recent decision. LiveWest asserts that the Inspector erred on a point of law, relating to the entitlement of Packsaddle Community Fields to protection, as an area of open green space, under ‘DP16’.

The Government Legal Department has today (Tuesday 28th October) acknowledged receipt of both submissions, and has indicated that it intends to respond to LiveWest by the end of Monday 3rd November. LiveWest will then have until the end of Friday 7th November – exactly six weeks from the date of the Inspector’s decision – to officially lodge an appeal, should it choose to do so.
